How are laws entered into the JIS Law Table if they are anticipatory violations like "Attempted" or "Conspiracy" to commit a crime?


Effective July 31, 2018, in an effort to improve JIS law table entries for criminal charges which include Criminal Attempt, Criminal Solicitation, Criminal Conspiracy, and Criminal Complicity updates are as follows:


New-For Solicitation (RCW 9A.28.030), the law table will have the law number for the underlying offense with .S on the end. The .S version will have the reduced penalty level (when appropriate) and "Solicit" in the title.


New-For Conspiracy (RCW 9A.28.040), the law table will have the law number for the underlying offense with .N on the end. The .N version will have the reduced penalty level (when appropriate) and "Conspiracy" in the title.


Partial Change- For Complicity (Aid/Abet) (RCW 9A.08.020), the law table will have the law number for the underlying offense with .C on the end. There is no change in penalty level and "Complicity" is in the title.  New-Current law table entry titles that contain "Aid/Abet" will be updated to Complicity to reflect the language in RCW 9A.08.020.


No Change- For Attempt (RCW 9A.28.020), the law table will have the law number for the underlying offense with .A on the end. The .A version will have the reduced penalty level (when appropriate) and "Attempt" in the law title.

When the charge information includes 2 RCWs, the law table entry that represents those 2 RCWs would be used on the JIS charge screen.   Prosecutors do not charge the law number with .S, .A. .N, or .C on the end, as this is only used in JIS to capture the charge consisting of 2 RCWs (JIS only allows one RCW per charge).
