What are the changes that must be completed by the Courts of Limited Jurisdiction because of ESB 5061 - Vehicle and Vessel Registration and Title Provisions?


NOTE: Changes to this law was made in the 2014 legislation with the effective date of 7/1/2015.  See Improper Display of Placard/Plate for current instructions on the Local Law Table.



The changes caused by ESB 5061 are meant to correct technical issues with the recodification of the Vehicle and Vessel laws taking effect on July 1, 2011. The recodification changed the law numbers of certain violations, and those changes WILL require the courts of limited jurisdiction to remove all local versions of the parking laws under RCW 46.16.381 and replace them with local laws under RCW 46.19.050. Additional statewide law table changes will be made by the Administrative Office of the Courts (AOC). The local law table updates must be made using the Fine Penalty Schedule Update (FPSU) screen prior to the effective date of the law, July 1, 2011.



NOTE: The existing laws can have a future end effective date and the new laws can be added in the FPSU screen with a future begin date.



The following is a detailed description of the changes to the parking laws. Additional instructions and demonstrations on looking up (Inquiry), end dating (Remove), or adding new laws can be located in the Fine Penalty Schedule Update (FPSU) screen portion of the JIS Online Manual Administrative Tasks.  An example of what the FPSU screen should look like when adding the new violations can be located attached to this answer.





Laws to be made "End Effective" in JIS (Local Law Table)



RCW 46.16.381(7) - Unauthorized use of a special placard, license plate or ID card.



Changes to be made:



  • Courts must "Remove" the current version of the PR local law 46.16.381.7.

    • Add the end effective date of June 30, 2011.

RCW 46.16.381(8) - Block access aisle.



Changes to be made:



  • Courts must "Remove" the current version of the PR local law 46.16.381.8.

    • Add the end effective date of June 30, 2011.


RCW 46.16.381(9) - Park in space for individual with disabilities



Changes to be made:



  • Courts must "Remove" the current version of the PR local law 46.16.381.9.

    • Add the end effective date of June 30, 2011.


If the court receives parking infractions from multiple jurisdictions, a local version of the law may have been added for each jurisdiction.  Please verify that all versions of this local law have the correct end effective date in JIS.



Laws to be Added to JIS (Local Law Table)



RCW 46.19.050(2) - Unauthorized use.



Changes to be made:



  • Courts must add the PR law 46.19.050.2 as a local law.

    • Recommended title:  UNAUTH USE OF SPECIAL PLACARD
    • Case Type is PR, Caseload Case Type is IP.
    • All flags are set to no (N).
    • Delinquent amount is set by local code.
    • Penalty amount set by statute is $450.
    • BARS Code to use is 354.00.07.
    • Effective Date: July 1, 2011.

  •  
  • If the court receives parking infractions from multiple jurisdictions, a local version of the law must be added for each jurisdiction.
  • A new Violation Code must be added to the Parking Violations Codes (PRKVIO) Table for any jurisdiction that sites to the court, so the parking code can be used to enter citations.

    • The new code is recommended rather than modifying the existing code so the law number change does not interfere with filings using the existing code.

RCW 46.19.050(3) - Inaccessible access.



Changes to be made:



  • Courts must add the new version of the PR law 46.19.050.3.

    • Recommended title: MAKE ACCESS AISLE INACCESIBLE
    • Case Type is PR, Caseload Case Type is IP.
    • All flags are set to no (N).
    • Delinquent amount is set by local code.
    • Penalty amount set by statute is $450.
    • BARS Code to use is 354.00.07.
    • Effective Date: July 1, 2011.
