Should the public defender's budget be part of the court's budget?
There is no state statute about this, but by policy the public defender's budget should be part of the executive budget, NOT part of the court's budget.
If the public defender's budget were included in the court's budget, a perception of bias would be created. Additionally, a conflict of spending priorities could arise.
